1. Introduction

These Terms and Conditions govern your use of the Highland Pony Society website and services. By using our website or services, you agree to these terms in full. If you disagree with any part of these terms, you must not use our website or services.

The Highland Pony Society is a Scottish Charitable Incorporated Organisation (Charity Number SC013562), registered at Garbh Allt House, Maidenplain Place, Aberuthven, Perthshire PH3 1EL.

2. Membership

2.1 Membership Types

The Society offers various membership categories including Life, Annual, and Junior memberships. Current fees are published on our website and may be updated annually.

2.2 Membership Benefits

Membership entitles you to reduced fees for Society services, voting rights at AGMs (for qualifying memberships), receipt of the Society newsletter, and access to members-only areas of the website.

2.3 Membership Renewal

Annual memberships run from 1st January to 31st December. Members are responsible for ensuring timely renewal to maintain continuous membership benefits.

3. Pony Registration

3.1 Registration Requirements

All Highland Ponies must be registered with the Society in accordance with the Breed Society Rules. Registration applications must include accurate information about the pony, its breeding, and ownership.

3.2 Accuracy of Information

You are responsible for ensuring all information provided for registration is accurate and complete. The Society reserves the right to refuse or revoke registration if information is found to be false or misleading.

3.3 Passports

Passports are issued in accordance with UK equine identification regulations. Passport holders are responsible for keeping passport information up to date and returning passports to the Society upon the death of the pony.

4. Shows and Competitions

4.1 Affiliated Shows

Shows affiliated with the Highland Pony Society must comply with Society showing guidelines. The Society is not responsible for the organisation or conduct of affiliated shows.

4.2 Judging

Judges officiating at affiliated shows must be approved by the Society. Judging decisions are final and are made at the sole discretion of the appointed judge.

5. Website Use

5.1 Acceptable Use

You must not use our website:

  • In any way that breaches applicable laws or regulations
  • To transmit unsolicited or unauthorised advertising material
  • To impersonate any person or misrepresent your identity
  • To interfere with or disrupt the website or servers

5.2 User Content

When submitting content to our website (such as classified adverts), you grant the Society a non-exclusive, royalty-free licence to use, reproduce, and display such content in connection with the website and Society activities.

5.3 Classified Adverts

Adverts must be accurate and not misleading. The Society reserves the right to remove any advert without notice. The Society is not responsible for any transactions between buyers and sellers.

6. Online Shop

6.1 Pricing

All prices are in British Pounds Sterling and include VAT where applicable. Prices are subject to change without notice.

6.2 Payment

Payment must be made in full at the time of ordering. We accept major credit and debit cards, and payment is processed securely through our payment provider.

6.3 Delivery

Physical items will be dispatched within the timeframe indicated at checkout. The Society is not responsible for delays caused by postal services.

6.4 Returns

You have the right to cancel your order within 14 days of receipt. Items must be returned unused and in original condition. Service fees (registrations, memberships) are non-refundable once processed.

7. Intellectual Property

All content on this website, including text, graphics, logos, and images, is the property of the Highland Pony Society or its licensors and is protected by copyright laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

8. Limitation of Liability

The Highland Pony Society shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our website or services. Our total liability shall not exceed the amount paid by you for the relevant service.

9. Complaints and Disputes

Any complaints should be submitted in writing to the Secretary. The Society operates a formal complaints and disciplinary procedure, details of which are available on request.

10. Changes to Terms

We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting to the website. Continued use of our services after changes constitutes acceptance of the new terms.

11. Governing Law

These terms shall be governed by and construed in accordance with the laws of Scotland. Any disputes shall be subject to the exclusive jurisdiction of the Scottish courts.
